Non-Emergency Concerns Involving States and Agreement States

State Program Concerns: The NRC does not regulate x-ray machines (including mammography activities), technologically enhanced naturally occurring radioactive material (TENORM), and nonionzing radiation activities (including lasers, microwaves, and tanning booths and salons). These activities are regulated by most State agencies. If you have concerns regarding these activities, please contact the appropriate State Radiation Control Program.

Agreement State Program Concerns: There are 39 States which have entered into an Agreement with the NRC, whereby the NRC has relinquished authority and those States have assumed regulatory authority over certain byproduct, source, and small quantities of special nuclear materials (referred to as Agreement materials). The 39 Agreement States are: AL, AZ, AR, CA, CO, FL, GA, IL, IA, KS, KY, LA, ME, MD, MA, MN, MS, NE, NJ, NV, NH, NM, NY, NC, ND, OH, OK, OR, PA, RI, SC, TN, TX, UT, VA, VT, WA, WI, and WY

If your concerns involve violation of requirements and wrongdoing by individuals or organizations involving Agreement materials located within one of the Agreement State's listed above, you may contact the State directly. Agreement States prefer direct contact since it allows the State to obtain all the necessary information and facilitates the ability of the State to investigate and respond to concern(s). However, please be advised that some Agreement States cannot protect alleger's identities from public release. Please see "Ability of Agreement States To Protect Alleger's Identity From Public Disclosure." For information on NRC's allegation program see Management Directive (MD) 8.8, "Management of Allegations." If you decide to contact the Agreement State directly after reviewing Exhibit 8, please contact the appropriate Agreement State Radiation Control Program.
